Law search is fundamental to legal reasoning and its articulation is an important challenge and open problem in the ongoing efforts to investigate legal reasoning as a formal process. This Article formulates a mathematical model that frames the behavioral and cognitive framework of law search as a sequential decision process. The model has two components: first, a model of the legal corpus as a search space and second, a model of the search process that is compatible with that environment. The (...) search space has the structure of a “multi-network”—an interleaved structure of distinct networks—developed in earlier work. In this Article, we develop and formally describe three related models of the search process. We then implement these models on a subset of the corpus of U.S. Supreme Court opinions and assess their performance against two benchmark prediction tasks. The first is to predict the citations in a document from its semantic content. The second is to predict the search results generated by human users. For both benchmarks, all search models outperform a null model with the learning-based model outperforming the other approaches. Our results indicate that through additional work and refinement, there may be the potential for machine law search to achieve human or near-human levels of performance. (shrink)

Legal reasoning requires identification through search of authoritative legal texts that apply to a given legal question. In this paper, using a network representation of US Supreme Court opinions that integrates citation connectivity and topical similarity, we model the activity of law search as an organizing principle in the evolution of the corpus of legal texts. The network model and probabilistic search behavior generates a Pagerank-style ranking of the texts that in turn gives rise to a natural geometry of the (...) opinion corpus. This enables us to then measure the ways in which new judicial opinions affect the topography of the network and its future evolution. While we deploy it here on the US Supreme Court opinion corpus, there are obvious extensions to large evolving bodies of legal text. The model is a proxy for the way in which new opinions influence the search behavior of litigants and judges and thus affect the law. This type of “legal search effect” is a new legal consequence of research practice that has not been previously identified in jurisprudential thought and has never before been subject to empirical analysis. We quantitatively estimate the extent of this effect and find significant relationships between search-related network structures and propensity of future citation. This finding indicates that “search influence” is a pathway through which judicial opinions can affect future legal development. (shrink)

An examination of Ian Parker's definitions of discourse reveals them to be non-distinctive and of limited utility. It is argued that discourse analysis should be integrated with, rather than set against, social psychology. Discourse analysts should attend to the issues of the representativeness and generality of their evidence, should be wary of attributing causality to discourse, and should consider the advantages of systematically investigating, rather than asserting, the social consequences of the use of different discourses.

While self-report data is a staple of modern psychological studies, they rely on participants accurately self-reporting. Two constructs that impede accurate results are insufficient effort responding and response styles. These constructs share conceptual underpinnings and both utilized to reduce cognitive effort when responding to self-report scales. Little research has extensively explored the relationship of the two constructs. The current study explored the relationship of the two constructs across even-point and odd-point scales, as well as before and after data cleaning procedures. (...) We utilized IRTrees, a statistical method for modeling response styles, to examine the relationship between IER and response styles. To capture the wide range of IER metrics available, we employed several forms of IER assessment in our analyses and generated IER factors based on the type of IER being detected. Our results indicated an overall modest relationship between IER and response styles, which varied depending on the type of IER metric being considered or type of scale being evaluated. As expected, data cleaning also changed the relationships of some of the variables. We posit the difference between the constructs may be the degree of cognitive effort participants are willing to expend. Future research and applications are discussed. (shrink)

: Research involving the dead, especially heart-beating cadavers, may facilitate the testing of potentially revolutionary and life-saving medical treatments. However, to ensure that such research is conducted ethically, it is essential to: (1) identify appropriate standards for this research and (2) assign institutional responsibility and a mechanism for oversight. Protocols for research involving the dead should be reviewed by a special committee and assessed according to nine standards intended to ensure scientific merit, to protect deceased patients and their families, and (...) to promote institutional integrity and responsibility. Federal regulation of research involving the dead will foster appropriate standards and, equally importantly, help establish the acceptability of such research. (shrink)

This paper locates its genesis in a small town called Vitebsk in Belorussia which experienced a flowering of creativity and artistic energy that led to significant modernist experimentation in the years 1917–1921. Marc Chagall, returning from the October Revolution took up the position of art commissioner and developed an academy of art that became the laboratory for Russian modernism. Chagall’s Academy, Bakhtin’s Circle, and Malevich’s experiments, artistic group UNOVIS—all in fierce dialogue with one another—made the town of Vitebsk into an (...) artistic crucible in the early twentieth century. We argue that this creative collective transformed creative energies of Russian drama, music, theatre, art, and philosophy in a distinctive contribution to modernism, structuralism and formalism that contributed richly to the social understanding of creativity itself that is so evident across Mikhail Bakhtin’s subsequent body of work, and elsewhere across the world. This paper argues that a consideration of such interplay has much potential for twenty-first century educational philosophy. (shrink)

The focus of this paper is to evaluate the impact of urban expansion on landuse types of Akure for the period of 1972 to 2009. In analyzing the u rban expansion of the cit y, 1972 MSS, 1986 Landsat Thematic TM and Landsat Enhanced Thematic Mapper Plus images for 2002 and 2009 satellite image captured from googleearth (...) website were used in a post classification comparison analysis to map the spatial dynamics of landuse / land cover changes and identify the urban expansion of Akure. Questionnaire was also used to determine the factors responsible for the expansion of Akure. The findings showed a rapid expansion in the built-up are a of Akure from 1.00% in 1972 to 2.46% in 1986, 2.46% in1986 to 3.90% in 2002 with an annual growth rate of 10.63% and 3.66% due to increasing population of Akure within these periods respectively. Prediction made showed that the built-up of A kure would expand to 2.66 % in 2022. Th e study recommends review of the outdated 1980 master plan and development control mechanism that will guide the rapid expansion that had been accompanied by loss of vegetation in Akure. (shrink)

This chapter compares the authors' naturalistic approach to epistemology to that of SAE. It is argued that the theories of SAE are structurally analogous to the naturalistic approach — they have at their core a descriptive theory, and from that descriptive theory, proponents of SAE draw normative, epistemological prescriptions. The prospects for the theories of SAE overcoming the is-ought gap are not good. The chapter also argues for the superiority of Strategic Reliabilism over any extant theory of Standard Analytic Epistemology.

This chapter offers a framework for understanding significance that tolerates our incomplete knowledge of the conditions for human well-being. Topics discussed include the role of significance in Strategic Reliabilism, a reason-based approach to significance, and the potential unavailability of objective reasons. It is argued that a proper understanding of the notion of epistemic significance is a core problem for any epistemological theory that claims to be able to guide reason, and that any epistemological view that gives a central place to (...) the notion of significance is bound to be deeply empirical. On one influential view, a person acts autonomously, doing what she genuinely values, if she acts on a desire that is her own, which is (on this account) a matter of it being appropriately ratified at a higher level. This view faces two problems. It doesn’t generalize, as it should, to an account of when a belief is an agent’s own, and does not let one distinguish between desires (and beliefs) happening to be one's own and their being the ones (...) a person would need to have in order to be autonomous. The paper develops an alternative unified account of what it is for desires and beliefs to be one’s one, and argues that an account of acting autonomously should pay attention not to which desires and beliefs are one’s own, but to whether they are ones the agent has reason to have and to act on. This chapter presents some concluding thoughts. It identifies three challenges that remain in the construction of a naturalistic epistemology. First, an effective epistemology needs to continue to discover handy new heuristics that help us reason reliably about significant matters. Second, we need to identify with more effectiveness what is involved in human well-being. A third project essential to the development of a prescriptive, reason-guiding epistemology is social epistemology.

This chapter introduces the three central features of the epistemological framework that guides the prescriptions of Ameliorative Psychology. It is argued that this framework offers a new way to think about applied epistemology. In particular, it suggests that there are four and only four ways for people to improve their reasoning.

This chapter discusses Strategic Reliabilism. The epistemological theory underlying Ameliorative Psychology is a view called Strategic Reliabilism: Epistemic excellence involves the efficient allocation of cognitive resources to robustly reliable reasoning strategies applied to significant problems. Strategic Reliabilism gives a systematic voice and a theoretical foundation to the long-standing success of SPRs while at the same time avoiding the most serious objections to traditional process reliabilism.

Strategic Reliabilism addresses resource allocation considerations within a cost-benefit framework. However, there are serious reasons to worry about the feasibility of a cost-benefit approach to epistemology. First, there are serious general objections to cost-benefit analyses; and second, it is not clear how we can identify the costs and benefits of reasoning. This chapter addresses these two concerns. It is argued that although many of the deep general concerns about cost-benefit analysis are legitimate, flawed cost-benefit analyses can be very useful, especially (...) if we are clear about the ways in which such analyses are flawed. It is further argued that there are measurable proxies for the costs and benefits of reasoning we can employ in a cost-benefit approach to epistemology. (shrink)

This chapter discusses Statistical Prediction Rules and provides an explanation for their success. SPRs are simple, formal rules that have been shown to be typically more reliable, than the predictions of human experts on a wide variety of problems. Based on testable results, psychology can make normative recommendations about how we ought to reason. The branches of psychology that provide normative recommendations are dubbed as ‘Ameliorative Psychology’. Two central lessons of Ameliorative Psychology are that when it comes to social judgment, (...) proper unit weight models outperform humans in terms of reliability and improper unit weight models often perform nearly as well as proper models and therefore better than humans. It is argued that the reason people resist this ‘practical conclusion’ is partly because the SPR results are noxious to our conception of ourselves as good reasoners. Further, they undermine our hope — so evident in the a priorism of so much contemporary epistemology — that we can be experts at recognizing good reasoning without massive empirical aid. (shrink)

The Continuous Parameter Estimation Model is applied to develop individual genomic-level heritabilities for the latent hierarchical structure and developmental dynamics of Life History (LH) strategy LH strategies relate to the allocations of bioenergetic resources into different domains of fitness. LH has moderate to high population-level heritability in humans, both at the level of the high-order Super-K Factor and the lower-order factors, the K-Factor, Covitality Factor, and General Factor of Personality (GFP). Several important questions remain unexplored. We developed measures of genome-level (...) heritabilities employing an American sample of 316 monozygotic (MZ) and 274 dizygotic (DZ) twin dyads and a Swedish sample of 863 MZ and 475 DZ twin dyads. This novel heritability index measures individual genetic transmissibility, therefore opening new avenues for analyzing complex interactions among heritable traits inaccessible to standard structural equations methods. For these samples: (1) moderate to high heritability of factor loadings of Super-K on its lower-order factors is demonstrated, evidencing biological preparedness, genetic accommodation, and the gene-culture coevolution of biased epigenetic rules of development; (2) moderate to high heritability of the magnitudes of the effect of the higher-order factors upon their loadings on their constituent factors, evidencing genetic constraints upon phenotypic plasticity; and (3) that heritability of the LH factors, of factor loadings, and of the magnitudes of the correlations among factors are weaker among those with slower LH speeds, demonstrating that inter-individual variation in transmissibility is a function of individual socioecological selection pressures. Sperber and Mercier maintain that argumentation is a meta-representational module. In their evolutionary view of argumentation, the function of this module would be to regulate the flow of information between interlocutors through persuasiveness on the side of the communicator and epistemic vigilance on the side of the audience. The aim of this paper is to discuss this definition of argumen-tation by analyzing what they mean by “communicator’s persuasiveness” and “audience epistemic vigilance”.

Numerous results about capturing complexity classes of queries by means of logical languages work for ordered structures only, and deal with non-generic, or order-dependent, queries. Recent attempts to improve the situation by characterizing wide classes of finite models where linear order is definable by certain simple means have not been very promising, as certain commonly believed conjectures were recently refuted (Dawar's Conjecture). We take on another approach that has to do with normalization of a given order (rather than with defining (...) a linear order from scratch). To this end, we show that normalizability of linear order is a strictly weaker condition than definability (say, in the least fixpoint logic), and still allows for extending Immerman-Vardi-style results to generic queries. It seems to be the weakest such condition. We then conjecture that linear order is normalizable in the least fixpoint logic for any finitely axiomatizable class of rigid structures. Truth of this conjecture, which is a strengthened version of Stolboushkin's conjecture, would have the same practical implications as Dawar's Conjecture. Finally, we suggest a series of reductions of the two conjectures to specialized classes of graphs, which we believe should simplify further work. (shrink)

Previous work suggests that relative increases in socially evaluative threat modulate the psychobiological stress response. However, few studies have compared stressors which manipulate the level of socially evaluative threat to which the participant is exposed. Here we present two studies. In the first, we assessed the integrity of an ecologically valid, laboratory stressor and its effects on acute psychobiological reactivity and ability to evoke an anticipatory response prior to participation. Specifically, we assessed whether the expectation and experience of direct social (...) evaluation evokes greater reactivity than indirect evaluation. In the second study, we sought to replicate the findings regarding acute stress reactivity whilst extending the assessment window to assess the extent to which the stressor evokes anticipatory responses. As hypothesized, greater reactivity was observed following direct social evaluation compared with indirect observation. Increases in anxiety, heart rate and blood pressure were demonstrated across both studies and the paradigm therefore provides an ecologically valid technique for the activation of psychological and cardiovascular stress responding. Additionally, anticipation of experiencing socially evaluated multitasking led to increases in anxiety, tension, and worry prior to the event itself, supporting previous suggestions that threat anticipation may prolong the activation of stress mechanisms. In the present studies we assessed whether the expectation and experience of direct social evaluation evokes greater reactivity than indirect evaluation. The findings have demonstrated that direct social evaluation of multitasking is a more potent stressor than multitasking with indirect evaluation. Furthermore, our findings indicate that the period of anticipation of stressful events may be critical to understanding the process of stress regulation, and as such we recommend extending the sampling window to allow for the investigation of these processes. Psychiatric diagnosis and prognosis is fraught with important philosophical and conceptual problems. This chapter focuses on some epistemological issues and moral issues that arise in contemporary psychiatric practice. It examines various clinical and actuarial techniques for psychiatric diagnosis, ordered very loosely in terms of how "structured" or "automated" they are. The chapter makes the case for assessing psychiatric treatments with controlled experiments, raises several epistemological dangers that arise from relying on uncontrolled investigations, and considers some of the unique methodological and (...) ethical issues that arise when trying to assess talk therapy. This introductory chapter presents an overview of the subsequent chapters in this book which will discuss topics such as epistemological theory, Statistical Prediction Rules, Strategic Reliabilism, and Standard Analytic Epistemology.

This chapter begins by giving two reasons as to why epistemology is important: epistemology guides reasoning, and people don't fully appreciate the risks and dangers of poor reasoning the importance of epistemology. It then introduces the basic motives and methods of the epistemology developed in the book. Topics covered include the standard analytic approach to epistemology, the philosophy of science approach to epistemology, the theories generated by the two approaches, and whether scientific investigation into normative epistemology possible.

This chapter uses Strategic Reliabilism to resolve two debates about whether certain experimental findings demonstrate deep and systematic failures of human reasoning. It illustrates one of the main benefits of the current approach to epistemology: it can be used to adjudicate disputes that arise in psychology that are, at bottom, normative epistemological disputes about the nature of good reasoning.

This chapter attempts to consolidate some of the lessons of Ameliorative Psychology with some handy heuristics and illustrative injunctions. It explores the empirical research that shows how to enhance the accuracy of diagnostic reasoning, reduce overconfidence, avoid the regression fallacy, improve policy assessments, and restrain the unbridled story-telling surrounding rare or unusual events. For problems tractable to voluntary reasoning strategies, the simple strategies recommended in the chapter can improve reasoning at low cost and high fidelity.
